The National Code of Civil and Family Procedures comes into effect in Mexico City.
On August 9, 2024, the “Agreement issuing the Declaration of validity of the National Code of Civil and Family Procedures in Mexico City, derived from the request made by the presiding magistrate of the Superior Court of Justice and the Council of the Judiciary of the Judicial Branch, both of Mexico City”.
In accordance with the provisions of the Sixteenth Consideration of said agreement, on December 1, 2024, the new National Code of Civil and Family Procedures (the “CNPCF”). Validity that, until June 1, 2025, will apply solely and exclusively to disputes processed in the special oral mortgage trial and in the special oral real estate lease trial (as far as it is concerned in civil matters), and for voluntary jurisdiction proceedings, in all its forms; any family dispute in which divorce is not raised; and those conflicts that are addressed through restorative justice.
With this news, both litigants and judges must be aware of the new procedural rules for trials that, starting December 1, 2024, must be conducted in accordance with the rules established by the CNPCF (National Code of Criminal Procedure).
